I am having the same Splash Screen error problem. I just bought the game today, did a full install and it wouldn't run. The splash screen would pop up for a few seconds, a little activity from the CD-ROM, and then nothing. No error message.
I updated my drivers and downloaded the Max Payne v1.01 patch. I ran dxdiag and there were no errors or funny stuff. No change in the error.
I installed on a pals PC and it ran fine.
My Specs:
Dell Dimension XPS T700
700Mhz Pentium III
Nivida RIVA TNT2 32mb
Turtle Beach Montego II
DVD-ROM
DirectX v8.0
Windows 98 Second Edition
I sent an email earlier today to Talonsoft tech support with my dxdiag information and the error. If no one has got this error solved, and they come up with anything I'll be sure to post the solution.

Just purchased and installed Max Payne. Installed patch. Same problem. Splash screen and some CD activity then nothing. Have all current drivers for hardware and software. Had this same problem regaeding Safedisk with the game Kohan. They had to issue a patch to fix. Go talk to TimeGateStudios at (www.timegatestudios.com)

If you're running Windows 2000 or Windows XP, Macrovision has a Safedisc fix (http://www.macrovision.com/solutions/software/fix.php3) that may help. You'll have to be logged in as an administrator to install it.
Also, try playing as an administrator. I could play only intermittently as a regular user, until I found a Safedisc workaround.

How come no one is responding to this problem?

I was having the same problems but have been able to fix it. I was running a virtual CD drive that had been installed with Daemon. After removing the virtual CD drive and Daemon I was able to play. I think that this is part of an anti backup move by the software makers.

Read through the support pages (http://www.maxpayne.com/support) and try the safedisk fix (http://www.macrovision.com/solutions/software/fix.php3) and as bill777 says, don't run virtual cd:s on the background.

Thanks for trying to help guys. I do not not even know what virtual CD is. Not running one. See my system description above. The Safedisc fix is only for NT based systems including Windows XP. I am running Windows 98.
I was looking for some support from Remedy or Talonsoft. I have called Talonsoft and they said they would call back. That was last Saturday. Sent them an email last Thursday. No reply. Filled out their trouble report on their website on Sunday. Received an automatic reply saying I would get a response. Nothing yet. Tech support sucks.
I even told them each time that many people, myself included had this same Safedisc problem with the game Kohan by TimeGateStudios. They fixed the problem by releasing a patch. Remedy, if you read this, maybe you should contact TimeGateStudios.

I was having this exact same problem.. (splash screen, CDROM spins a few seconds, then, nothing)..
I UNinstalled the "ImageDrive" (Virtual CD ROM) that comes with NERO, and that fixed it!

Why is Remedy not resolving the Safedisk problem?

JOED3R,
I do not know what email you are talking about. I have done the following. All of these occured over a month ago with no responses to any off them.
I sent Talonsoft an email explaining my problem of not being able to start Max Payne on August 23.I received no response.
I called Talonsoft on August 25. They said they would call back. They have never called back.
I filled out the trouble report on TalonSoft's website on Sunday August 26. Received an automatic reply saying I would get a response within 24 hours. Nothing yet.
I posted a message on the 3D Realm Forum on August 26.No response. There are at least half a dozen other topics posted with people complaining about the same problem with the SafeDisk Copy Protection.
You do not even acknowledge the splash screen problem in your tech support forum post: "Remedy posts an update on technical issues - we urge to to PLEASE READ THIS FIRST!". Your message at the top of the tech support forum states "Run into problems with Max Payne? You need to check out this link before posting a question. This area is updated reuglarly with the latest workarounds and known fixes. It's entirely possible your question has already been answered. Please check that out before posting. Thank you." It has not been updated since August 16 over a month ago. That is not regularly!!!

Well, did you send in the info to the email that was requested? They can't resolve it without feedback. If you did, thanks for that - but these things aren't instanteanous (sp?). It takes some time to research.
