The esc key wont work

I having a problem with the keyboard. Most keys, like shift, enter and space works fine, but the "esc" wont respond. So I cant exit the game, cant save, and all that. What is wrong? Played the game through once, and it worked fine, but then i had some probems with my machine, installed the xp anew, and installed Max Payne once again. It was then that the "esc" thing started

Athlon 1133mhz
128 ram
tnt2 ultra with 14.70 detonator drivers
soundblaster live
windowsXP

From what I've read, this is a Windows XP Beta 2 problem.

I know the problem doesn't exist with Windows XP RC2, but I'm not sure about Windows XP RC1.

and press F5 for a quick save and F9 for quick load images/icons/wink.gif

cant seem to get any of the "top" keys to work, ranging from "esc" to f12.
tried to run it in win98 compatiblaly mode, and still the same problem
