I'm not sure what kind of crash you're having. Here are the release notes for the patches: Max Payne v1.01 Patch - July 26th, 2001

The patch to version 1.01 addresses the following issues:
- Exit to desktop stability issues addressed:
The issues with the game crashing into Windows' desktop when loading a new map have been addressed.
- Game doesn't start with some CD-Rom drives:

The patch to version 1.02 addresses the following issues:
- The clock and other desktop icons are no longer randomly flashing when playing the game.<font size="2" face="Verdana, Arial">

I've been waiting a while for the Vertex Buffer-patch. Dammit, that bug's annoying, but it'll be nice when it's fixed.
