Yeah Max WAS seen leaving the subway station after Alex's murder, but wouldn't the cops who found Alex's body have seen all the bodies of guys with guns? Wouldn't they have found the people in the vault? And Max left their score behind! How come they want to arrest Max?????

I wouldn't be surprised, if the police in NY are anything like the ones here in britain - if you so even touch a criminal (i.e. thump the living crap out of them - in self defence) you're the one who gets locked up.

Max is undercover as an informant but only Alex and that other guy know, and the other guy is a bad guy. So the police think max is a hood so they assume hes the one who killed alex.
