Sorta. I was reading an article about hip-hop mixtapes at mtv.com, and noticed this curious paragraph:

"Mixtapes have not been mere collections of obscure or unreleased tracks — over the years there have been major releases of important music desired by legions of fans, though most likely heard at first only by streetwise hip-hop aficionados who know where to score the tapes. Try topping the one-two punch of "The Realest": This track, on DJ Whoo Kid's mixtape Max Payne 2, combines never-before-heard vocals the Notorious B.I.G recorded before he signed to Bad Boy with a new verse and chorus laid down by 50 Cent." <font size="2" face="Verdana, Arial">Weird. I did a search on this, and I found that there was also a Max Payne mixtape.

Mixtapes are usually made by DJs who compilate music that is many times original or as yet unreleased (which is how old unreleased tracks for 2Pac and Notorious BIG can seem new). It's power as a "underground" marketing tool is growing.

The DJ is not asserting that these are soundtracks to the games. This particular DJ just decided to name and package his mixtape with the "Max Payne" theme (perhaps because he enjoyed the game). Max Payne 2 is merely the follow-up to his mixtape Max Payne, and has nothing to do with Remedy's follow-up.

Since they sell these CDs for around $10, this does seem to be pretty clear copyright infringement.
