Anyone have any idea why the patch installer cites that the game is not installed and then exits?

Which version of MP2 have you ? American or European ? If it's the European one it could be 'cause it's already 1.01 version

This is the American version purchased from Gamestop. And the patch is definately not installed because Chapter 3 sections will not load.

Sure would be nice to get a little help. It's frustrating not being able to enjoy this awesome game because of a minor glitch. Anyone?

Did you install MP2 to "C\Program Files\Rockstar Games\Max Payne 2", or did you install it to a custom path?
I've seen custom paths cause issues like that before.
Did you install as an administrator (or even as another user), then try to patch from a different user account? If the patch (running in your context with whatever permissions you have) doesn't have permission to read/modify the proper registry objects (registry objects have permissions and ownership with NT-based OSes like WinXP), an error like this could result. This can be particularly true if the patch needs to read/modify objects in HKLM, which often has tighter permissions than HKCU.
This kind of permissions error could also happen at the filesystem level if you installed outside of Program Files, as Program Files has wider permissions than the root directory does.
This isn't a piracy accusation (many legit owners do this to spare themselves the annoyance of a CD check) but are you running a "No CD crack"? I've seen this cause issues as well.
Back when I used cracks, I would rename the existing .exe, then add a copy of the cracked .exe, so that I would have a fallback path if another patch was released.

The path that I installed the game to was the path that was dictated by the installer. I checked it yesterday to make sure and it is the "C\Program Files\Rockstar Games\Max Payne 2."
I have sole access to the computer with no other accounts set up. My computer is about as plain vanilla as they come.

Nothing special has been done to it or the game itself. No "No CD Crack" is running, nothing running in the background. I even downloaded the patch again to make sure it wasn't some file error, but I received the same error - Max Payne 2 installation not found. Set-up will now exit.
I am starting to think that either no one has any idea on how to remedy this problem or that the developers don't care. Either way I'm dissappointed that I am not able to finish the game, considering how much I was enjoying it. If anyone has any solutions or advice I would appreciate the help.

I had this issue too:
Go to My Computer -> Control Panel -> Add / Remove Programs, you might find Max Payne 2 is not on this list. For some reason when I first installed Max Payne 2 everything seemed fine yet according to windows no such game was installed. I uninstalled Max Payne 2, by deleting the folder, and reinstalled, this time it appeared on the add / remove list and the patch then worked fine.

In general the the only reason the patch "won't install" would be something going wrong in installing the Max Payne 2 game.
I'd be happpy to hear if you guys got any errors during the install, or did you perhaps cancel the install right at the end or something?

After reading Wibble's post I took his advice and deleted the Max Payne 2 folder as the game was not showing up on the add/remove program list. After I reinstalled the game I attempted to install the patch . . . and it worked!!! Wibble, you are the man. Thanks to all for the info.
SamiV, as far as any abnormal occurances during the original install, there were none. The installation went smooth as silk with no second attempts needed (aside from the patch issue). So I am still a little confused as to why the game would not show up in the add/remove program list untill I reinstalled it. But it works now, so I'm happy.

Cool glad to hear it's working now.
The only problem I got during install. Max Payne 2 installation asked for CD 3, I inserted CD 3 and it came up with a blue screen, the typical "CD not in drive, disk may be damaged or need cleaning etc"
I took the CD out, gave it a wipe, reinserted the CD and installation continued as normal, or so I thought. But regardless it’s now installed and it runs.
