I'm not sure if this has been asked before, but I couldn't find any such topic using the UBB search.
Anyways, I've heard from mappers that it would be legal to use the textures from Max Payne texture packs, in other games as long as you don't take money from it.
I didn't believe it then, but I kinda got the idea too when I read the license. But since 3Drealms is very strict with it's copyrighted stuff, I still have my doubts.
So is it legal to use these textures in other non-profit games/mods?

technically you can't release anything with copyrighted work in them, unless it originally was included with the game you are modding.
For instance, if you wanted to use MP2 textures with let's say, UT2004 for instance, that would technically be illegal.
However, if you were using the MP2 textures on MP1, that would technically be legal, not only because both games are made by the same company, but both games share the same legal permissions for modding.
Now, for the reality check. chances are, that if you do release a mod for a different game, using MP2 material, you're not going to have your local law enforcement breaking down your door, or Remedy's lawyers sending you a subpeona. (Especially considering the ratio of converters to scratch builders is like 10:1)
so basically, what you want to know is yes, it is illegal, yes there is the very slight possibility of a lawsuit if you do, but the real question you should ask yourself is "Do I want to take the easy way out, or take the time to do it the right way, and get 1,000 times the respect?

I was browsing the net few days ago and found one mod level to other game (was it one of the quakes, don't remember) but they used MP1 textures in it and they even mentioned it, they use them to get dirty look to the map.

When the MP1 textures set was released to the modding community, many belived the readme okay'd their use in other game mods as well.
Going from MP1 textures to RTCW textures, only reaffirmed how unique MP1 was as a game!
The MP1 textures are really too small now making for low quality results to be used in MP2 IMHO.
Altering a copyrighted texture is also illegal. ID has been really stringent about it.
I am surprised that Marvel Comics hasn't taken steps to suppress mods also, licensing game developers seems a logical step for them?

I'm pretty sure I've heard of at least a couple cases where Marvel shut some people down, but I don't remember any specifics at this time.
