Has this ever happened before?
Has a publisher ever sued the developer for not making a game before or is 3DR the first?

nope, happened before.

I'm trying to think of one that got sued, but i think there were a few in Europe recently.

I have heard of some developers getting sued recently as well, like last month. But I can't think of one prior to TT suing 3DR.

Most developers fail to deliver because they go under. A non-existent company can't be sued, and neither can the people who worked there.

That's why it's not super-common.

Well, Bethesda has just sued Interplaying, for failing to develop a Fallout MMO.

I was trying to look up a few examples yesterday, but from what i saw, it's the other way around or more commonly for copyright violations.

That's a misconception. It's nothing to do with them failing to develop a Fallout MMO, failing to develop it implies they actually started development. At a very basic level Bethesda are suing Interplay for failing to secure the funding required to develop a Fallout MMO by the deadline set in the contract and defaulted on the license to produce the game, while Interplay is claiming otherwise despite being in very hot financial water. However, that case is a lot more complex with Interplay taking a lot of liberties with Bethesda's copyrighted property.

Historically, more often than not, it's developers suing publishers for not holding up their end of the agreement, but it related to funding, time, being given the middle finger or whatever. In the last couple of years, though, it's turned to publishers suing the developers for failing to get a game released under prohibitively restrictive conditions and while being mistreated by the publisher in ways which litterally stops them developing it.

Previously you'd get games being cancelled by the developer and you'd never hear of them, the publishers wouldn't take legal action. These days, you get games cancelled by the publisher and the dev sued for not finishing the project, despite it being cancelled by the people suing them for it being cancelled, else they just get fired.

I thought they were getting sued for distributing their "Fallout trilogy" pack online without permission from Bethesda.

While the pack has been in regular distribution for ages, and Iply has the rights to continue to distribute it, there's some argument on wether or not the games in the pack have been altered for the re-release. Since Beth owns the actual assets, any alterations to FO products have to go through them. Lastly, a Beth employee raised the issue of name similarity between the "Fallout trilogy" and "Fallout 3", and has been quoted as saying that the pack was riding on FO3's coat-tails.

Why sue it wastes money and you lose respect, T2 couldn't think of another way except this way. Things could of been sorted with negotiating and co operating in a team effort.

This has happened before with other people that get pissed at something, which did not happen in the gaming industry.

I wouldn't be too surprised if T2 actually started the lawsuit hoping 3DR would just bow down and settle out of court, which would sort the publisher out a solid couple million easilly. If you look at T2's financial state right now they are in terrible condition and need all the money they can get.

If they cared about games they would be a dev studio, not a publisher.

All this crap now-a-days reminds me of how sports has changed. It used to be a bunch a guys enjoying what they did and some glory. Now, athletes get paid more in 2 or 3 years than any of us would see in our lives and steriod riddled for the sake if winning games acording to contract just for the sake of apeasing investors. NOT the fans.

To a point, the same principle can be applied to the current gaming industry.

Of course. I was simply saying about player payments. They can have big bonuses from the country, though.

But take basketball for example. All those Dream Teams were not there for the money, right?

Btw, I wonder how much winter's 2012 will suck ass.
