It's somewhat confusing - even to me.

I fail to see how that is relevant. In fact, it's not. This is no different than things like Prey, Earth No More, Scott's Radar stuff, etc. It has no impact on DNF at all. Whether we have one month or 5 more years of DNF development to go, this new stuff today has no bearing on DNF in any way.
OK, so since they're making Duke Nukem Trilogy...who exactly has the rights to Duke Nukem? Do you share them?

We can license the rights to Duke Nukem games to whomever we want to make them. Like the old PS1 games that n-Space did, or the cel phone games that Machine Northwest made. The Apogee Software Duke Nukem games that were announced today are no different. It just seems confusing since the company that licensed the work is also named Apogee.

Having said that, it will be marketed as Apogee Software. The stuff you guys are getting into here is the nitty gritty stuff of Apogee Software Ltd vs LLC and all that. They'll be "Apogee Software" games. That's something that hasn't been since since 1996 with Stargunner. From a personal standpoint, it'll be nice to see the old name out there again, since I was a paying customer back before I started working here.

As for Bryan's remark about Action Entertainment... Thanks Mr. Smartass. Apogee Software, Ltd is a wholly owned subsidiary of Action Entertainment, Inc. That way if someone sues us, they're suing AEI, the company we (on paper) all work for, not us personally.

So, there will be 3 different games if I get things right...

I'm sure that someone will suggest this eventually, so I might as well get it out of the way.

The new Apogee should make a Super Smash Bros. type game where you can fight as Duke, Cosmo, the wizard from Hocus Pocus, etc. Major Stryker could have a special move where his space ship flies in like an Arwing and shoots the place up. Nevada Smith can summon a mummy or some bad guy from Arctic Adventure. I won't mention Commander Keen since he's id's IP, but I'm sure we'd all like to trample bad guys with his pogo stick. Even the gun would be fun. Of course, if you licensed Commander Keen, you'd have to get B.J. Blazkowicz, because who kicks more ass than he does? Once you start thinking about it, the possibilities are pretty much unlimited.

This is not, of course, a serious request. I just wanted to put that out there before someone else did. It's less corny than what most companies do when they have a lot of popular characters, which is make yet another Mario Kart clone.

See you need some context for this. Apogee Software, Ltd is a limited partnership, limited partnerships have two kinds of owners limited partners with limited liability and general partners with unlimited liabililty.

Action Entertainment, Inc is the general partner of Apogee Software, Ltd. Its officers are George Broussard and Scott Miller, they are also the limited partners of Apogee Software, Ltd, maybe you have heard of them ?

One is Apogee Software, Ltd(The company on who's forum you are now posting) and the other is Apogee Software, LLC. The latter is licensing the company name, logo and various IP's/brands from the former but other wise there is no relation.

Joe, are we gonna get a new, updated, fully orchestral rendition of the Apogee Fanfare? Or did they not license that part?

Edit: In other news, I am suddenly glad I did not sell my PSP last month when I was considering it.

I can't answer that stuff. I honestly have no knowledge. Yeah, I've known about this venture for some time, but for obvious reasons I couldn't say anything. What you ask me here I honestly don't know - and I'm not hiding anything. We (the original Apogee, now known as 3D Realms) aren't involved in this venture beyond what Scott Miller has said and has been quoted a bunch today.

Specific questions about titles, features, things like the "fanfare" isn't something I as a 3DR employee can answer. Quite simply because we aren't doing it.

From a personal standpoint when we stopped putting out games under the Apogee name in 1996, we had just gone to a new version of the fanfare for Stargunner. Turned out it was used in just one title. Whether that gets used, they do something new, or have no fanfare at all is up to them. Although I PERSONALLY would hope they'd use a version of the old fanfare.

Considering that most of the IP's were left to the developers, how likely is it for us to see new games from those old IP's? Or will they focus on new IP's and games?

Somehow this still is confusing, no matter how much I pretend it not to be. Apogee Ltd. and LLC. what is the difference? Apogee Ltd. - 3D Realms are a subsdiary of somesort, but are in no relation with the LLC version of Apogee? Is there some company on top of all these, or is the "new" Apogee something totally different? Well, I guess I am still confused...

I am not that aware of US company structures

Re: Apogee revived!
What I'm wondering about: Apogee Software, LLC has bought the rights to use the logo and titles of Apogee Software, Ltd.. So it's another company using the assets of 3D Realms, yet Scott said "It's a real rebirth.". Does this mean there's a big percentage of original Apogee Software, Ltd. developers involved, or is that just a marketing trick?

Well first you need to keep in mind this quote by Scott:

Quote:
Correction: 3DR has nothing to do with the new Apogee, other than helping to set it up -- but no management role at all. It's a real rebirth, and has access to several original Apogee brands/titles.
So in other words there is no relation as such between "new Apogee" and 3D Realms(old Apogee), both just happen to have "Apogee Software" as their legal name. But the one doesn't own the other or anything like that, there is no company on top of them or anything.

So:

A)There is no ownership relation
B) Ltd and LLC just signify that the companies are two different form of companies, one(3D Realms) is a Limited partnership and the other is a Limited liability company.
