Would be very cool, if, in the end of DNF, duke kills the final boss and search his remains to find... BUBBLE GUM!! "I already have kicked ass, but I was outta gum. Now I have kicked ass, and I have gum. Let's chew!" and the game ends with Duke CHEWING GUN besides the boss corpse!

Why would he be chewing GUN. I know hes a tough guy but GUNs are made of steel. Perhaps GUM would be most appropriate in this instance unless the GUN was made of an edible material, perhaps cornstarch and biodegradable. Pedantic ? Its important to get the detail right, right ?

Have you ever heard of a phrase "Revenge is a dish best served cold"? It's from star trek and I've heard it in a lot of tv series that had nothing to do with st... "Come get some" is just another legendary phrase and as long as people know where it came from, there is no problem.

Why would Duke pass up an opportunity to kick ass to go chew bubble gum? If it was OR, does that imply that "And I'm all outta gum" mean that he'd rather chew gum first over kicking ass? Unlike Duke. I agree with Theplease.

I think Duke likes a bit of flavoring with his kicking ass. Or, maybe Duke has a bad habit of chewing his nails and really can't do it because he's holding the chaingun, so he's chewing gum instead? Or maybe it's perhaps that it's a stress decreaser, allowing him to chomp on his gum and release his stress while shooting lizard troppers? I'm sure he'll be chewing the hell outta that gum (if he had it, since he's all outta gum) if he was fighting a boss.

Duke must get bored of shooting all the time, and he can't really sit down and play a video game or something like we are playing DN3D. A simple stick of bubble gum will satisfy his day. Now that he's al out of gum, he's bored again. The strippers can only do so much, too.

What if Bubblegum was an inventory item that allowed you to kick ass harder, and your weapon damage would increase?

Have a real cheek seeing that it was Ash Williams line to begin with, but you can not trademark a phrase.

it seems you can, also it seems you can even patent inexistent stuff only based on a theory and rough sketch.

as for the phrase well it's a movie and it's there as a phrase, its pretty normal that movies quote, show and/or make reference to trademarks, most of the time trademark owners don't mind about that, as long as it doesn't affect them in a negative way. So it's not a big deal IMO.

I really would argue that Phrases can't really be trademarked especially ones only 3 words long. It would only come into a possible court case if passing off where to occur, I.E the film was about a muscular guy with sunglasses.

Well put it this way I doubt they'd win anything in a court battle and It'd be a real brass neck to try as Duke has ripped lines from Die Hard, Terminator, Indiana Jones, Back to the Future, Unforgiven and They Live to name a few.

Of course, if something is shown to be satire then it's perfectly fine to use lines from Indiana Jones, Die Hard etc.

Ever heard of "fair use"?

After the release of DN3D id Software tried to sue 3dRealms for using the phrase "That's one doomed space marine", an obvious pun at Doom. That was pretty dumb, and it would be equally dumb if 3dR sued for the "come get some" phrase.

Sigh. Those who can - do. Those who can't - sue.
