3D COMMANDER KEEN 4 - need help

hi there

we're working on commander keen mod for UT 2004, and we need all the help we can get. game will be 3rd person shooter and will use some kind cel-shading to give a better feeling to our mod.

Have you received permission from ID Software ?

You have to otherwise the mod is illegal.

i whoul like to contact ID, but it seems that i cannot find their email adress. really, check out idsoftware.com! you can contact activision and bunch of other, but no email adress directly to ID!

on the other side, this mod is considered as a free fan game (+ keen4 is free), so why Id didnt contact any of authors of dosens of keen fangames? my fangame idea is similar to others except my fangame is 3d and based as mod for ut2k4

might work - might not.
Clear all this up *before* you invest lots of effort into that mod. Because if it's not legal - all will be for nothing ... just look at that ChronoTrigger Fan Project.

But it's your decission. You wouldn't be the first one to think that it probably won't happen to you. Just be prepared that it still might be shut down.

What was that one a few years back...Keen and the Moonstone...they were goin' good for a while till id got wind of it and shut the project down.

If you don't get the permission for some reason, you could call it "Commander Ken" or something like that instead and present it as a "parody"...

i didn't post email to ID because I still need help for my mod, so i'm not so shure if i'll continue to develop it. i can't do all stuff by my self - my knowledge of 3d editing is pretty limited. if someone whould add cel shading and sector over sector to jfduke, i whould probably finish it in couple of mounths. but i choosed UT engine beacuse of its great graphic possibilities, but now i don't have any people to help me on the mod... the only 3d modeler from my team droped out because of his loose of interest in mod...

That too can be a problem if it's determined that doing that is just there to get around using the same thing.

On your site it says you have a Duke3D mod but there is no downloads section!
I would help if it was for Quake2... UT2k4? Ya, Im gonna upgrade my system then play a mod that could have been made for a game that more people are able to run...

Agreed. Slapping the word "parody" on something isn't enough to qualify for fair use. It's a matter of debate whether id software would actually CARE about one of its long-dead, no-longer-profitable franchises being parodied, but that's no excuse for not contacting them beforehand. I believe you can contact them on their webpage via "Licensing."

Parodies are legal, but you have to ensure that the game is a parody in every sense of the word - you have to make fun of the characters, situations, and so forth from the original games, and ideally get a lawyer to check it out.

The problem is that while you may not want to make the project commerical, you might still derive a 'profit' from it - whether it's something you can put in a portfolio when looking for a job or something like getting more hits to your website, where you're selling something...laws are very open to interpretation, to give lawyers more money.

iD would have both copyrights and trademarks on Commander Keen, so the name and character itself might get you in trouble. Hey, if George Lucas can shut down Star Wars fansites...

I'd have a look through various copyright and trademark laws (most if not all are online), and I'd also have a look at the DMCA (Digital Millenium Copyright Act).
