Fourth of June Two-Zero-Zero-Nine
On that day, what will happen.

Will 3DR and TakeTwo just meet in court, and they appoint lawyers and sign papers and then set a new date, or will it begin for real with maybe some results.

I guess it will take some time. I'm only familiar with the judicial system of Sweden, and we don't have corporal punishment, something I bet many ppl want for TakeTwo messing with the Duke.

Does anyone know what procedures are likely to happen. How many steps before there is a verdict, time-span if we're lucky?

I think I am not the only one asking these questions, but I haven't seen a thread where the legal system is discussed more thoroughly.

The hearing on the 4th is just about the injunction/restraining order request.

Take Two's lawyers will present their case as to why it should be granted, and 3D Realms' lawyers will present their case as to why it should not.

That's all that hearing is for, per the actual court documents, nothing else about the case will be heard on June 4th.

Considering capital punishment is only assigned to felonies (criminal law), I don't think we'll be hearing it in a civil case.

Anyway, timeframe is probably at least a few months, if it does go to court.

The judge comes into the courtroom wearing the traditional full length black robes, plus a long judges wig and ... sunglasses?

His left hand suddenly reaches up, ripping off the wig and robes in one fell swoop to reveal Duke Nukem, complete with rocket launcher in his right hand. He fires a rocket at Take Two's legal team, gibbing them all over the courtroom, slams the rocket launcher down like a judge's gavel and says, "The prosecution is out of order. Case dismissed!"

It looks like Take Two filed a notice of removal on May 29th. Dropping the case or just dropping the injunction/restraining order request? Who knows?

EDIT: On second thought, I think this is just a technicality.. something to do with moving the case from federal court to state. Who knows with legal jargon.

They'd get absorbed by the all consuming Microsoft who would make DNF an Xbox 360 and PC Windows Live exclusive, releasing the game as one level at a time episodic content to the tune of $15 a pop for each one.

The point here is that the Court will decide whether Take 2 is legally entitled to money, and to how much, not to punish 3DR for how much or little work they may have accomplished.

It looks like some one has filed a "notice of removal" on 29th May moving the court case from state courts to a federal court. So basically we now have to wait for a new hearing date in the federal court. See here for more details

Now who filed the "notice of removal" is not clear, but it looks like it is 3DR because federal courts have a faster hearing time + simplified pleading. Also I think it was not Take 2 who filed that because Take 2 from there prospective would have liked to get the restraining order in effect as early as possible. So my common sense says is 3DR who filed it. Round one to George.

As far as I know it takes both parties to agree on a removal from a court or a judge to rule on it. Has anyone looked for court records from the 29th to see if a judge had anything to do with the removal?

Looks like both parties don't have to agree to move it from state to federal, just certain conditions have to be met. See the info lordlonelobo posted (post #57) in the thread below:

Yes but a judge still has to give it the OK and there should be a court record stating who/what and when. Maybe US courts aren't as public as Canadian but up here you can get court "minutes" very easily.

Here in the U.S. it seems to depend on where the court is located, i.e. some states are more open with their info. Some seem to only give out certain info unless you're an attorney and some (I believe) are so behind the times they don't even have online documentation yet. Not sure how good/bad the federal court online records are yet.

Even those that put all the information online seem to do it in a "when we get around to it" fashion, IMO.

Accuracy is questionable too. I'm sure anyone who's looked up the case in NY, they've noticed that the defendant is listed as APOGEE SFOTWARE, LTD. Court couldn't even be bothered to spell the name of the company right or at least realize it and correct the record in a reasonable amount of time.

Like I said, I'm not a lawyer, but it might not be necessary for a judge to give it the okay. I think the purpose of the Notice of Filing of Notice of Removal is to allow the other party time to appeal the decision before it is actually removed.
