Question Duke Nukem objects to yourself.
Hello
I am a very big fan of Duke Nukem, and I would like to see a picture of Duke Nukem to make a poster and hung with me and wanted to know if I had the right as the right to belong 3DRealms.

(Sorry for the spelling, I'm French and I write with google translator).

While we are offering free opinions, I am no mod or judge, but it is my opinion that the second post is a waste of space...

Anyway... If you made a poster for yourself to hang on the wall, I don't think there would be much of any chance for legal action even though technically it is not legal.
In the most simple of terms... If you don't OWN the picture, you can NOT legally make a copy unless granted the right by the copyright holder.
Same for games... but with the gray area of backup copies. You can't legally make a backup copy of an image that I know of.

What is legal and what is enforced are completely different. This is why you see unlicensed merchandise for Duke Nukem on the internet often. T-shirts, clocks, watches, fake money, fake credit cards etc. All of these are illegal technically.

However... if you make two Images and "transfer" one to someone else (give, sell, trade, etc) that is asking for trouble.
And… If you display the image in a business or location that attracts people and subsequently causes you to receive income, then it is "more" illegal and therefore more likely to be enforced.
Also... if you have your own printer/plotter to do this, all will be well, but no company can risk printing material with a copyright.

That is my understanding and experience.

This is different from country to country. I am pretty sure it's perfectly legal to make a poster for your own use in Sweden for instance. Making copies of movies and music for a family member is allowed for instance. Using an on-line service that makes money from printing custom posters may not be though (as mentioned above as well).

This is probably a pretty grey area in most places as "fair use" is usually allowed and I doubt anyone has ever been sued over making something for personal use only even though it may be technically illegal in some countries.

I agree... if this is something he is making for his own use to put up in his room there really is no problem with it... in fact I'm sure 3DR would be flattered.

I agree with you (Nacho) and Parkar... I don't think there would be any real complications, from making something for yourself and your own use especially when you own related products.

Just don't go into business selling them and their should not be a problem.

In some cases there is a condition of non-competition also... where an entity begins making a related product that is not an area already licensed. Like Duke Nukem Ice Cream Bars for example... because the rights to make this type of product are not licensed it limits the type of legal action that can be taken. But if you started making action figures back when Resaurus had the rights to the figures, then there are multiple avenues of legal action by the rights holder and licensee. In the case of Ice Cream Bars, it still is not your Art or IP, but the legal options are different.

I have been making my own game t-shirts for years and do not feel that this violates anything morally as there is no current licensed Duke Nukem shirt being made. The ones on eBay are not under license. I buy most any that are.

If I had access to a big fat plotter I might make me some Duke Nukem posters also.
