I agree its take two's fault for trying to take dnf for themselfs and realsease it them selfs. They do you not have rights over duke only 3dr does always will.Besides i thought gta4 sucked and i beaten the game t2 is not all that great. How can it be T2's fault ? I don't see how.
3DR just couldn't deliver the damn game after 13 years + they never needed financial support but for the last sprint they needed 5 million from T2? And when T2 makes an offer for the games IP, GB just cant stay polite and says that they need to STFU. He asks for money and tell them to STFU .... wow. + not delivering anyting after 13 years.
It must be T2's fault.

So the article seems to contradict itself - they took the 2.5 million, and they agreed to what?

In any event, the details won't be to complicated for a judge - perhaps that's where this should go.

It is a good article about not letting your pride about your creative abilities stop a project from having a damn end game.

It's certainly 3D Realms' own fault that the game wasnt finished and released before the internal development was shut down, but it's Take 2's fault that the plug was pulled at the tail end of development.

According to all the reports and statements about the project's state of development when the excrement hit the fan, DNF was in the "end-game" stages of development. It had reportedly met all the proposed milestones and then some but T2, reportedly, had decided to completely change the agreements they had previously made with 3DR.

I can't see how that is 3D Realms' fault. Pretty much any developer takes the word of their publisher as gospel, if they were told they would have funding at that point then they would have budgetted accordingly.

The blame looks even more likely to lay entirely on Take 2's shoulders as they're yet to address why they refused to give the previously agreed funding and support in the first place. They just pointed in the other direction saying "But they shut down development! They had no right to do that! It's all their fault!" without bothering with the reason development was stopped.

The amount of time it had been in development is a null point as far as this whole situation is concerned as this entirely revolves around assurances given by Take 2 which weren't upheld.

Of course this is just my take on it, going on the reports and documents released from both companies and ex-3D Realms employees. There's no hard "evidence" available to any of us which would say for certain what exactly happened and why. Chances are we'll never know, even when the court case is done with.
