Max Payne sued

According to a newspost from the german online gaming mag gamigo.de, some american wrestler has just sued rockstar games (don't get why they always bring rockstar in connection with max payne).

Darryl Peterson aka. "Man Mountain Rock" but also "Maxx Payne", who is professional wrestler in the WCW and WWF wrestling leagues, has sued rockstar for illegal use of "his" name as the main title of the game.

so after that new face Max has gotten, maybe he even gets a new name? [img]images/icons/tongue.gif[/img]

ahh, you can't do anything since maxx payne is technically not max payne...

2nd of all, I know someone named max payne (his real name) and he can't sue either because it's a fairly common name here in the us...

This game obviously doesn't depict the wrestler in any way and therefore he can't do anything 'bout it..

Also, Rockstar games owns the rights to max payne which is why rockstar is getting sued and not 3drealms or remedy...

That would be as silly as Rockstar suing those who made the movie Rock Star for using a similar name. Actually that would almost make more sense, stupid as it is.

They also write that name likenesses in games and movies are not intended and are purely coincidental, this guy's name isn't even Max Payne.

i remember that McDonalds has been sued because some dork has boiled his finger by pouring coffee over accidently. and yes, the suit has passed, because the judges decided that the coffe has been too hot and there has been no warning on the cup. that guy has received some million dollars.

However, it would be hard to get that case accepted into any court here in Finland, because the plaintiff would be laughed out. As would have happened with the "spilled hot coffee on myself" and "McDonalds made me fat" lawsuits.

There are a couple of practical reasons too:

Class action lawsuits (ie. a group of people suing a company) are not applicable under Finnish law. Only individuals and individual companies may sue.

Also, the compensation for damage you get for suing someone and winning are not as astronomical in Finland as they are in the USA. It's not an economic jackpot to sue. You can expect to be adequately compensated, but it won't jet-set you and your dog.

First, the McDonalds made me fat suits were thrown out.

Second, what we really need is a law that says if you lose a suit you have to pay the person you sued's legal fees, like they do in England. Frivolous law suits usually are thrown out if they make it to court, the problem is that they often don't because it is more expensive to pay legal fees than it is to get an out of court settlement.
