Is The Court Case Active or Not?
The idea that the case is no longer in active status and has been "disposed" (no one has any idea what that could mean in this context) has surfaced several times in this community. During the most recent analysis, several people have concluded that the case is no longer active. There are several questions that come to mind when thinking about this possibility, such as, "Why are George and Scott still referencing the lawsuit and behaving as though it were still a threat?" and "Why haven't any statements come from Take-Two or 3D Realms about the disposal itself?" Personally, I have no idea what to think about anything related to this game anymore, but what's your opinion? Do you think that the court date still exists on the horizon, or is the case "disposed?"

People need to type this "what does disposed mean in a court case" into Google. I have found in multiple places that this means that a case has been concluded.

I understand that, but the reference in question clearly states that the case was disposed to a federal court. By itself, stating that the case was "disposed", sans "...to federal court", would most likely mean the case was over. The inclusion of "...to federal court" cannot be ignored.

I'm not a lawyer, but the New York Southern District Court is a federal court. Can I get a link to the paperwork that says the case was moved to federal court? From what I am seeing it looks like it MIGHT have been dismissed from a federal court.

All valid points, but did you check the date for when it was disposed? It's not a new update, it's old news. If old news was the case being over, we would know by now, and we wouldn't be receiving useless "OMG, can't talk, law suit" responses from ass clowns.

I'm not sure we would know. Unless 3DR or T2 tells us, how would we know the case was over? Nobody here seems to be able to provide solid evidence as to whether the case is still active or not. Just because we have "ass clowns" telling us that they can't talk about the game because of the suit doesn't mean there still is a suit. Maybe the agreement they came to included a provision that neither party should let the public know that the court case is over, and neither party should release media until an agreed time before the release of the game. I know we have been lied to a bunch of times by 3DR about what is in production. The most recent example I can come up with would be with Joe adamantly denying the existence of the XBLA D3D port right up until official media was released and the game was "officially announced." My guess would be that if the court case was settled, neither party would talk directly about the existence of DNF until a date agreed upon when an "official announcement" could be made.

i just hope they release it before everyone forgets about 'ol Duke... our generation is definitely getting older... quick...

If the case were over, and there was some sort of gag order on both parties, there would still be evidence in legal documentation. It would state who won, but in the event of a gag, there would be no conclusive statements apart from who won. Not even why they won.

It also seems that the original injunction wasn't launched Federally, as the first page of the court docco says "SUPREME COURT OF THE STATE OF NEW YORK" and "COUNTY OF NEW YORK".

If the case was disposed of and settled by the parties themselves we would not have a court document stating who won. I would assume we would have documentation stating that the case was removed or disposed from court which we seem to have. Again I'm no lawyer so I really don't know much about the documents I have seen, but if the case was ongoing I would assume there would be a date set for it and it would be public knowledge.
