I am quite sure that ADM is very well aware of the relationship between 2K Games and Take Two.

There is a group or two of shareholders that own 30-40% of TTWO's stock. Although this isn't a controlling interest, it is enough for them to bring issues before the board at the annual shareholders meeting. They want to replace the CEO and a few of the board members.

They already did. The CEO and most of the board of directors have now been replaced.

i`d really hate to see MAx payne 3 take down the MP quality average. i mean, MP 1 and 2 are gems, true pieces of art, i`d really hate to see part 3 be a "Average" game.

No games are ever in production until announced. The mere fact that we know of a possible Max Payne 3 is because Take 2 buying the rights is known to the public. If it wasn't for companies having to disclose their franchise purchases, we wouldn't know that Bethesda is developing Fallout 3.
