DNF being back on track will mean that it is back in development, with no ETC, infrequently released screenshots, and so forth. the worst thing that can happen for duke is to be "back on track".

WTF is going on with todays communication? If anyone out there, no matter if George, Scott or whoever has something "descent" to say about this business, or DNF, why can't they be a little more specific about it?

I like to distinguish information in 3 categories:

A: usefull/productive information

B: shallow information

C: baboon shit

so 3DR works on the completion of DNF...what if DNF is finished sometime next year and the lawsuit is still not settled. What would Take 2 do? If I would be in their shoes I would stop that stupid lawsuit and put DNF on shelves!

And before the IP belonged to Radar it was 3D Realms IP.

Sure it is. If DNF is completed, T2 have no cause of action, because they're suing on the basis that DNF is NOT going to be completed. DNF completed = no more case. As wayskobfssae said though, that'd pretty much be the definition of a Christmas miracle.

Correct. Plus if it is not finished when the lawsuit finally goes to court, if 3DR could show that the game is actively being worked on and will be ready long before the Oct 2012 deadline then T2 also has no case. The only way T2 has a legitimate case is if development on DNF stops indefinitely which for some reason feels very unlikely to me. It seems as if 3DR has something up their sleeve regarding DNF.

I seriously doubt Prey did well enough to get moved at a price that would be able to fund DNF.
